Provider Terms of Service

Agreement to these terms

These terms govern provider use of Mom's Next Best Home. By creating an account, accepting these terms, purchasing a service, publishing a listing, or using the provider platform, you agree to these terms and acknowledge our Privacy Policy. If you act for an organization, you represent that you can bind it to these terms.

Leads and metered charges

  • Billable leads are charged through metered usage. Lead prices, billing methods, and billable events may change; the material terms shown when a charge is incurred control.
  • A lead is unique for seven days. Engagement after that period may be treated and charged as a new lead.
  • Queued leads remain available for 30 days and may be permanently lost if they are not purchased during that period.
  • Names, contact details, messages, qualification details, and provider internal notes are scheduled for redaction 24 months after a lead's last activity unless a documented legal hold applies. Minimal pseudonymized billing, consent, and outcome evidence may be retained for seven years.
  • Lead caps may determine whether a lead enters the active inbox or queue. Purchasing or releasing a queued lead may create a metered charge.

Listings, contracts, and renewals

  • Listing fees are based on the physical resident capacity of the facility or unit and the selected billing option. You must provide and maintain accurate capacity information.
  • A listing may be billed monthly or annually, but every paid listing has a one-year contract term. Annual billing may include the discount shown at checkout, and mid-cycle monthly additions may be prorated.
  • Each listing renews for another year unless cancellation is requested at least six months before its renewal date. A late request takes effect at the following eligible renewal date.
  • Listing fees and lead-meter charges are nonrefundable, including unused time, mid-term removal, or leads that do not convert, except where required by law or expressly agreed in writing.

First-listing promotion

An eligible first-time provider may receive a three-month promotional listing period beginning when its first standard listing goes live. The promotion applies once to the provider account, not separately to each listing, and has no cash value. Lead usage and paid team-seat overages continue to bill during the promotional period. The offer shown when the first listing is published controls.

Professional photo package

  • Photo and video results vary, and the package does not guarantee a particular result or fixed number of photos.
  • Before accepting the initial package, you may request a 50% refund. If you choose refund and reshoot, you receive the 50% refund and one replacement shoot without another provider-facing charge.
  • You may not retain or use rejected work. Accepting delivered assets ends the refund window. Later reshoots and reshoot orders are nonrefundable.

Your listings and content

You retain ownership of content you submit and grant Mom's Next Best Home a worldwide, nonexclusive, royalty-free license to host, copy, format, display, distribute, and promote it as needed to operate and market the platform and your listings.

You represent that you own the content or have permission to use it; that facility, licensing, capacity, pricing, availability, service, and contact information is accurate; and that your content does not violate law, infringe rights, mislead, discriminate unlawfully, threaten, harass, exploit, or contain obscene, hateful, malicious, or otherwise offensive material.

You may use lead information only to answer the selected inquiry and provide related follow-up requested by that family. You may not sell or resell it, add the family to unrelated marketing, or use it for an unrelated purpose without a separate lawful basis and consent.

If you connect a CRM, you are responsible for mapping the correct community and maintaining an inquiry-only source that does not enroll families in automated marketing. You must promptly disconnect or disable the integration if those safeguards are no longer in place.

Billing and account responsibilities

You authorize charges for purchases, recurring fees, metered usage, renewals, taxes, and other amounts you approve or incur. Keep payment and account details current and protect account access. Failed payment or material violations may result in restricted access, unpublished listings, suspension, collections, content removal, or termination.

Platform role and availability

Mom's Next Best Home provides discovery, listing, communication, and lead services. We do not provide medical, legal, financial, or placement advice and do not guarantee any facility, family, lead, placement, transaction, or outcome. The platform is provided “as is” and “as available” to the fullest extent permitted by law.

Changes and liability

We may update services, pricing, and these terms prospectively, with notice when required. To the fullest extent permitted by law, Mom's Next Best Home is not liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages. Liability that cannot lawfully be excluded is limited to the amount you paid us during the 12 months before the event giving rise to the claim.
